Please read this agreement carefully before renting. By renting space at oStorage, you agree to the following terms and conditions.
This Rental Agreement and Liability Waiver ("Agreement") is entered into between oStorage, located at 12397 Camino Real, Kyle, TX 78640 ("Facility"), and the individual or entity renting storage space ("Tenant"). By renting space at oStorage, Tenant acknowledges they have read, understood, and agreed to all terms herein.
All rentals at oStorage are month-to-month. There are no long-term contracts. Tenancy begins on the date of first payment and continues on a monthly basis until terminated. Either party may terminate this agreement with 30 days written notice. oStorage reserves the right to terminate any tenancy immediately for violation of this Agreement.
Rent is due on the same day each month as the start date of tenancy. Payments not received within 10 days of the due date are considered late and subject to a late fee of $25. Accounts more than 30 days past due may result in the removal or locking of stored property at Tenant's expense. oStorage accepts payment via [payment methods to be listed].
Tenant agrees to use the rented space solely for the storage of lawful personal or business property. The following are strictly prohibited:
TENANT STORES ALL PROPERTY AT THEIR OWN RISK. oStorage, its owners, employees, agents, and representatives shall not be liable for any loss, theft, damage, or destruction of Tenant's property stored at the facility, regardless of cause, including but not limited to:
Tenant expressly waives any and all claims against oStorage for loss or damage to stored property.
Tenant acknowledges and accepts that oStorage is an open, outdoor, unpaved storage facility. Tenant understands and agrees that:
oStorage does not provide insurance coverage for Tenant's stored property or vehicles. Tenant is strongly encouraged to obtain their own insurance coverage for any property stored at the facility. oStorage assumes no responsibility for uninsured losses.
All vehicles must be legally owned or operated by Tenant. Vehicles must be in operable condition unless prior written approval has been obtained from oStorage. oStorage reserves the right to tow, at Tenant's expense, any vehicle that is abandoned, unlicensed, or associated with an account in default.
Tenant will be provided gate access credentials upon execution of this Agreement. Tenant agrees not to share access credentials with unauthorized individuals. Tenant is responsible for securing their own stored items with their own lock. oStorage does not guarantee the security of the facility and is not responsible for unauthorized access.
In the event of non-payment or violation of this Agreement, oStorage reserves the right to deny gate access, assess late fees, and pursue all remedies available under Texas law, including the assertion of a storage lien pursuant to the Texas Property Code. Tenant's property may be sold to satisfy outstanding balances after proper notice as required by law.
Tenant agrees to indemnify, defend, and hold harmless oStorage, its owners, agents, and employees from and against any and all claims, damages, losses, or expenses arising from Tenant's use of the facility, including any injury to persons or property caused by Tenant or Tenant's guests.
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from this Agreement shall be resolved in the courts of Hays County, Texas.
This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions or agreements. This Agreement may only be modified in writing signed by both parties.
By signing below, Tenant acknowledges they have read, understood, and agreed to all terms of this Rental Agreement and Liability Waiver.
